Other provisions to take into account is the anti terrorism law, also called the Anti-terrorism, Crime and Security Act 2001 (ATCSA). This legislation introduced a voluntary code that made it possible for details of every website visited, the transmission of every email sent and every phone call made in the UK to be retained and made available to authorities on request. The potential for such requests has raised privacy concerns. Yet for telecommunications companies and internet service providers faced with the consequent storage and retrieval requirements.
ATCSA has been followed by European Union legislation, the Data Retention Directive 2006. The Data Retention Directive was implemented in the UK in respect of telephone communications in relation to fixed telephone lines and mobile telephones by the Data Retention (EC Directive) Regulations 2007, which together with the ATCSA voluntary code, have now been superseded by the Data Retention (EC Directive) Regulations 2009 (2009 Regulations). The 2009 Regulations extend the range of data to be retained to internet related data which is defined to include data arising from 'internet access', 'internet telephone services' and 'internet e-mail' (in addition to fixed network telephony and mobile telephony communications data).
Since Una Inc. Ltd. DOES NOT use any "communications proprietary" service or app, and since all the encrypted messages, texts, or calls made from and to a UnaOS device are not hosted in the UK nor European Union, Una Inc. Ltd. cannot be held liable for such user informations. In addition, the encrypted communications apps have no government-mandated backdoors. The encrypted chat, calls or sms cannot be intercepted, wiretapped or read in "plain text" since is in use end-to-end encryption and cannot be decrypted by any MITM (man in the middle) attacks, nor the servers keep any logs. While making a new call, the devices will be creating a new secret password and the old one gets deleted. This means PFS (Perfect Forward Secrecy) is in use. For creating new passwords the technology used is the ECDH(Elliptic curve Diffie-Hellman) with 521 bitlength. The call and chat encryption used is the well known and tested AES 256 bit algorithm normally used for top secret communication. The texts (SMS) are also encrypted and secured the same way. The encrypted email service we provide is not managed by us, and the registration is completely ANONYMOUS and provide the maximum security in the "email communication field" ensuring that the communications cannot be intercepted or read in "plain text". Those informatins on the servers are also fully encrypted and not available in "plain text" to the service provider, making them IMPOSSIBLE to read and cannot be decrypted by any third party. Una Inc.Ltd. have not any open access to the data stored on any of the services servers, and since there is no Personally Identifiable Information or Sensitive Personal Information stored, we cannot comply to any communication data disclosure request. That way we ensured ourselves that there is NO WAY to positively identify any user that uses our devices.
Of course, Una Inc. Ltd. and the services provided are also NOT AFFECTED by any US laws nor we have to abide to any request made by any US government or law enforcement agency under any act (Patriot or other)!
This way Una Inc. Ldt cannot provide to any government and law enforcement agencies, the disclose of any data related to communications. What we can disclose, if there is a legal demand, is a very limited information we hold, but there is NO WAY the device and the communications can be positively identified.
Before disclosing any information, we will evaluate the request to make sure it 100% complies with the law. When legally permissible, we will notify the user in order to give him or her the opportunity to object to the disclosure.
We will also enforce an online transparency report regarding the government and law enforcement requests for subscriber data containing details about the number of requests we have received, from whom, and how many customers were affected.
